Anthony Chavez is a commercial trial attorney with 14 years of experience representing clients in complex business disputes in state and federal courts, arbitrations, and on appeal. Anthony has substantial trial and arbitration experience and approaches every case as if it is headed for trial, building the record, the witnesses, and the themes from the outset. He uses sharp pretrial advocacy, including motions in limine, to set his clients up for success at trial. Clients appreciate his consistent track record of results, including dispositive motions, injunctive relief, favorable arbitration awards, and a published appellate opinion.

Anthony has a particular emphasis on healthcare litigation. He represents surgery centers, management services organizations, accountable care organizations, telemedicine companies, and physician owners in disputes involving corporate governance, ownership buyouts and dissociations, breaches of fiduciary duty, and healthcare provider lawsuits against insurance companies. Anthony also advises healthcare clients on Stark Law and Anti-Kickback compliance, as well as surgery center peer review.

Drawing on his Silicon Valley college experience and prior work at a technology company, Anthony brings strong technical proficiency to his practice. He regularly handles trade secret misappropriation matters, advises clients on privacy and data protection issues, and is a Certified Information Privacy Professional (CIPP/US).

Anthony also represents both plaintiffs and defendants in real estate and general commercial litigation, including partnership and shareholder disputes, employee theft and embezzlement, fraud, contract disputes, and unfair competition claims.

Representative Matters

Commercial Litigation

  • Secured a published appellate opinion in In re Civic Partners Sioux City, LLC (8th Cir. BAP) 553 B.R. 355, successfully reversing a bankruptcy court’s dismissal under the deferential abuse-of-discretion standard by demonstrating the court applied the wrong lease terms and failed to appropriately consider the debtor’s ability to confirm a plan.
  • Obtained a favorable settlement during arbitration for a partner in a residential lending company who was wrongfully denied a contractually guaranteed buyout.
  • Secured a favorable settlement on the eve of federal trial for the plaintiff in a shareholder oppression lawsuit in which the majority shareholder secretly formed a competitor and diverted clients to freeze out the minority owner.
  • Achieved a favorable settlement in a partnership dispute involving fraud in inducing investment and subsequent embezzlement of partnership funds.

Healthcare Litigation

  • Secured a multi-million dollar arbitration award after hearing for an LLC member who was wrongfully deprived of his membership interest in a management services organization through breaches of fiduciary duty.
  • Obtained a favorable settlement for a telemedicine company after securing a temporary restraining order and preliminary injunction against a majority member who attempted to drain the company’s operating account and sabotage operations while forming a competing business.

Experience

Before joining Novian & Novian, Anthony practiced at Nixon Peabody, Friedman Stroffe & Gerard, Best Best & Krieger, and Downey Brand, where he represented small and large companies, public agencies, and individuals in complex civil, criminal, and administrative matters.

Anthony graduated from Stanford University in 2008 where he earned a B.A. in both Political Science and Communication.  Thereafter, Anthony earned his Juris Doctor from the University of Southern California Gould School of Law where he was a Topic Editor on the Hale Moot Court Honors Program Executive Board and a member of the USC Law National Moot Court Team.
